| In Indiana-breaking apt lease, have to pay extra months rent after
moving. Do i have at least 30 days 2 pay? Am buying a house and going to give the apt manager a 30 day notice when we close on the house. Apt manager said we can break lease, but will have to pay an extra months rent after we move because the lease is being broken. They are being nice about it, but my question is, can they make us pay that extra months rent immediately, like on the day we move out, or by law do we have at least 30 days to make that extra months payment? Or can they make us pay upon movin out? If they say it has to be paid, and we dont pay till 30 days later, what steps could they take?

| Re: In Indiana-breaking apt lease, have to pay extra months rent after I cannot answer your question definitively - but have some items to bring up fyi: 1) If you have been in the apartment over 1 year then your lease has been satisfied and a 30-day notice should suffice with any moneys you end up owing for rent and or damages over and above your deposit amount. 2) If you paid first and last when you moved in then, you have already answered the stipulation you mention. So far as your question on speed of payment - my best and only advice is to read your lease. You should have a certain amount of space based on your own freedom of choice but I would hesitate to advise you any farther since I am not familiar with Indiana law. Sorry I can't be of more assistance - but your lease should spell it out for you. If not, ask your landlord or their supervisor. It sounds like they are willing to work with you so now, it simply comes down as to how well informed and educated they are on your behalf. You can also contact your HUD regional office for further information ... but the time-delay would probably not suit your purposes ... give it a go anyway. Best of luck.

Did you give them a deposit? I don't know, if you didn't have an out clause in your lease, you're on the hook for the rest of the term of the lease, I believe, but if they only want 1 month's rent, you could be getting a good deal then.

I would say it depends on two things. 1) what does your lease say? 2) what is the state law?
