I purchased a home 5 years ago in Texas. I have broken up with my boyfriend and

he refuses to move? out of my home stating that he was rights to my home eventhough I purchased this home on my own and he moved in with me. We have had an 8 year BOYFRIEND/girlfriend relationship. I have never claimed to be his wife nor he has claimed to be my husband. Does he have a right to my house?

It depends on the agreement you had from the beginning. If he was giving you payments towards the mortgage under the assumption that it was a home to be shared, then he may have some recourse in court. If he was smart, he would have given you a check and wrote “mortgage” on the bottom of each check to prove that he was paying a mortgage and not rent.

If you did not have an agreement, then you can kick him out of the home based on your state’s tenant/landlord guidelines. In Florida, it is 3 days. Other states is as low as 1 day as high as 30.

Also there are certain states (very few) that recognize common law marriages. Texas is one of them. He may be entitled to the home.

Funny how its "your" house now but I'm sure it was "our" house every time he helped with repairs, maintenance, and bills. Let this be a lesson.

I would seek an attorney and ask him for his help. If the equity is enough to keep then have him evicted. If you just want a clean break, have the attorney pursue him refinancing the property and put everything in his name. I don't think you have to worry about much with an attorneys help, Texas is a state that favors women in rulings...(I don't agree with Texas ethics..just stating facts.)

Is he on the contact as part owner? If not.. call the cops and tell them to remove his looser ass. No based on the little info I have here, he has no rights. He is in your home. Why he would want to stay is beyond me.
